SPINAL TRACK INDEMNITY/DECLARATION FORM
PLEASE READ CAREFULLY BEFORE SIGNING. BY SIGNING THIS FORM YOU ARE CONFIRMING THAT YOU UNDERSTAND AND AGREE TO THE FOLLOWING PARAGRAPHS AND DECLARATIONS WHICH ARE DESIGNED TO CREATE A LEGALLY BINDING RELATIONSHIP IN RETURN FOR YOUR BEING ALLOWED TO PARTICIPATE
MOTORSPORT CAN BE DANGEROUS AND MAY INVOLVE INJURY OR DEATH
In consideration for being permitted to participate in SPINAL TRACK (‘the Event’) :
1. I acknowledge and realise that participation in the Event is potentially dangerous and that there are inherent risks associated with my participation. I accept that, despite SPINAL TRACK (‘ST‘) taking all reasonable precautions, damage or injury may occur. I acknowledge and voluntarily accept these risks and take part in the activity at my own risk.
2. I hereby declare that I am in good health and I do not suffer from any medical condition or undisclosed disability which is likely to affect my normal control of a car or which makes it unsafe for me to drive or otherwise participate in the Event. I am not taking drugs (prescribed or otherwise) or alcohol that will impair my ability to take part and I will not participate in the Event whilst under the influence of alcohol or intoxicating drugs.
3. I hereby declare that I am competent and able to take part in the Event and that my eyesight (with appropriate corrective lenses if required to be worn) is to the standard required for a road driving test.
4. I accept that I shall be solely responsible for any decision that I might make as to fitness to participate in the event at any time throughout the day.
5. I currently hold a car driving licence entitling me to use on the public roads in the U.K. This licence was reapplied for post injury. I have shown my licence to the track day organiser.
6. I will satisfy myself before taking part in any on-circuit activity that the circuit is acceptable to me with regards to its features, hazards and physical layout.
7. Any vehicle for which I am responsible for and/or which I will be using during the course of the Event is in good and suitable mechanical condition, fit for the purpose for which I have attended the Event and that it meets the safety standards required by law (if applicable).
8. A helmet and seat belts must be worn by me at all times whilst using a vehicle during the Event
9. The use of any vehicle is entirely at my risk and I accept responsibility for any damage caused to any vehicle (whether controlled by me or any other person) and myself.
10. I understand that ST are not liable for any loss of driving time due to circumstances that come under the control of the circuit management and decisions that they may take.
11. I understand that the organisers are not responsible for any adverse weather conditions and any affect this may have on the event.
12. I understand that the organisers and the ST Instructors reserve the right to remove me from the circuit at any time if they consider my actions to be dangerous or detrimental to other users, or not representing the best interests of ST. The manner of my machine control whilst out on circuit shall be courteous towards other circuit users.
13. I accept that I am not participating in a timed speed trial, race or competition type event.
14. I accept that whilst under any form of advice or instruction, I am solely responsible for my actions during and thereafter.
15. I accept that I am totally responsible for my actions and accept that I am responsible for my safety and the safety of others around me whilst taking part in this Event.
16. No claim of any kind arising from my own negligence, error or omission or otherwise (including without limitation in respect of any damage to any car or other equipment I intend to use at the Event) shall be made by me, my guests or on my behalf or on behalf of any of my dependants against ST, any instructor(s) or any company or organisation connected with the Event (‘Relevant person’) or any of their respective employees, agents or assistants, or any other participant in the Event.
17. Neither ST nor any other Relevant person shall be liable for any loss, damage, claims, costs, expenses, injury or demands suffered directly or indirectly by me as a consequence of my attendance at or participation at the Event provided that nothing in this form shall exclude ST or any Relevant person’s liability for personal injury or death caused by its negligence. I shall reimburse ST and other Relevant persons against any loss or liability suffered by them as a result of my error, default, act or omission.
18. Due to the seats and harnesses required for circuit driving and the forces exerted on the body, be aware that injuries such as bruising and pressure sores may occur.
19. I accept that the ST team and volunteers are not responsible for any injury whilst aiding ingress and egress from the car. If I need help with entry/exit, I should ask my guest to help.
20. Spinal Track may take photographs and/or video footage of me during this event and may use such photographs or footage for future promotional, marketing and publicity purposes in any media worldwide without notice or payment.
